MET IN REGULAR SESSION
The Board of Supervisors met in regular session at 10:00 A.M. All members present. Chairman Shea presiding.
PLEDGE OF ALLEGIANCE
Chairman read the Public Comment Policy statement.
1. CONSENT AGENDA
After discussion was held by the Board, a Motion was made by Miller, and second by Jones, to approve the Consent Agenda and to move item 8B to open session as item 4E:
A. September 15, 2026, Minutes as read.
B. Auditor’s Office – Employment of Kayla Scofield as a Real Estate & Drainage Specialist.
C. Auditor's Office - Employment of Douglas Weiler as an Election Coordinator.
D. Public Health – Employment of Nicolina Kempf as a Public Health Preparedness Coordinator.
E. Secondary Roads – Employment of Jackson Woltmann as a Tractor/Trailer Operator.
F. Renewal of Special Class C Retail Alcohol License/Outdoor Service to Pioneer Trail Orchard and Pumpkin Patch L.L.C. d/b/a Pioneer Trail Orchard and Pumpkin Patch, Council Bluffs.
UNANIMOUS VOTE. Motion Carried.

3. SCHEDULED SESSIONS
Bethany Wilcoxon/McClure Engineering, and Courtney White/City Clerk, Minden appeared before the Board to give an update on Minden Recovery.

Motion by Jones, second by Jorgensen, to approve Second Consideration of Ordinance No. 2026-05, an ordinance to amend the Official Zoning Map of Pottawattamie County, Iowa by changing the district designation of approximately 3.77. acres from a Class C-2(General Commercial) District to a Class A-4 (Loess Hills) District.

ORDINANCE NO. 2026-05
AN ORDINANCE to amend the Official Zoning Map of Pottawattamie County, Iowa, by changing the district designation of approximately 3.77 acres from a Class C-2 (General Commercial) District to a Class A-4 (Loess Hills) District.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF POTTAWATTAMIE COUNTY, IOWA
SECTION 1 - AMENDMENTS: That the Official Zoning Map, as adopted by reference in Section 8.003.020 of the Pottawattamie County, Iowa, Zoning Ordinance, be and the same is hereby amended by changing the district designation from its present designation of a Class C-2 (General Commercial) District to a Class A-4 (Loess Hills) District, of certain real estate, as shown on the attached plat and which is legally described as follows:

SECTION 2 - SEVERABILITY: That should any section or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, that decision shall not effect that validity of the Ordinance as a whole or any part thereof, other than the part so declared to be invalid.
SECTION 3 - REPEAL OF CONFLICTING ORDINANCES: That all ordinance or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.
SECTION 4 - EFFECTIVE DATE: This Ordinance shall be in full force and effect after its passage, approval and publication as provided by law.

Motion by Wichman, second by Jorgensen, to approve Bil-Den Glass proposal to replace three failed window units at the Health Services Building in the amount of $8,144 to come from Building and Grounds budget.

Motion by Wichman, second by Jorgensen, to approve Board Chairman to sign Quote for UKG additional modules to come from IT budget.
UNANIMOUS VOTE. Motion Carried.
4. OTHER BUSINESS
Motion by Miller, second by Jorgensen, to approve the following applications made to the Assessor’s Office: Homestead (99 recommend allowed, 6 recommend disallowed), Military (15 recommend allowed, 0 recommend disallowed), Disabled Veteran Homestead (13 recommend allowed, 0 recommend disallowed), Family Farm (8 recommend allowed, 0 recommend disallowed).
UNANIMOUS VOTE. Motion Carried.
Motion by Wichman, second by Miller, to approve and authorize Board Chair to sign contract with WIQ Spark for the Employee Wellness provider effective date of November 1, 2026.
UNANIMOUS VOTE. Motion Carried.
Motion by Miller, second by Wichman, to approve sending letters on IPERS employee contribution refunds to claim contributions made for employees who have quit within 6 months of employment with program effective September 1, 2026.
UNANIMOUS VOTE. Motion Carried.
Motion by Jones, second by Jorgensen, to approve the County Attorney’s office to begin tax sale certificate redemption for a property at the legal description of North 40 feet of Lot 15, Block 2 in Noe’s Addition to the Town of Walnut, IA.
UNANIMOUS VOTE. Motion Carried.
Motion by Jones, second by Miller, to approve the Board Chair to sign the 90-day extension of the due diligence period of agreement with Sequitor America LLC, with $25,000 of $50,000 earnest money to be non-refundable and claimed by Pottawattamie County.
UNANIMOUS VOTE. Motion Carried.
5. COMMITTEE APPOINTMENTS
A. Update from Board members on Committee meetings from the past week.

A. Out of State Travel Notifications):
1) Jail – Out of State Travel for Amy Garreans.
2) WIC – Out of State Travel for Wei Eng Kay and Kristine Wood.

1) Sheriff Report of Fees Disbursed and Collected for August 2026.
7. STUDY SESSION
Jeff Franco/Executive Director, Conservation, Garfield Coleman/Director, Safety and Risk Management, and Jason Slack/Director, Buildings and Grounds appeared before the Board to discuss Conservation Infrastructure Projects.
Discussion only. No Action Taken.
8. CLOSED SESSION
Motion by Miller, second by Jorgensen, to go into Closed Session pursuant to Iowa Code 21.5(1)(i), for discussion and/or decision on personnel matters.

Motion by Jones, second by Jorgensen, to go out of Closed Session.

Motion by Wichman, second by Jorgensen to reinstate 10 hours of regular pay as discussed in Closed Session.
