MET IN REGULAR SESSION
The Board of Supervisors met in regular session at 10:00 A.M. All members, except Supervisor Miller present. Chairman Shea presiding.
PLEDGE OF ALLEGIANCE
Chairman read the Public Comment Policy statement.

After discussion was held by the Board, a Motion was made by Wichman, and second by Jorgensen, to approve:
A. September 8, 2026, Minutes as read.

3. SCHEDULED SESSIONS
Motion by Jorgensen, second by Jones, to open Public Hearing on proposed preliminary plat of Pioneer Meadows Subdivision,a subdivision situated in Lewis Township.

Motion by Jones, second by Jorgensen, to approve and authorize Board to sign Planning and Zoning Resolution No. 2026-13.
PLANNING AND ZONING
RESOLUTION NO. 2026-13
WHEREAS, the proposed preliminary plat and supporting documents for Pioneer Meadows Subdivision Phase 1, a subdivision situated in Lewis Township, has been filed with the Pottawattamie County Planning and Zoning Commission for its study and recommendation under Case #SUB-2026-07; and
WHEREAS, said Commission conducted a public hearing on August 17, 2026, in accordance with Chapter 9.04 of the Pottawattamie County, Iowa, Code and Chapter 354, Code of Iowa, and has given all parties an opportunity to be heard; and
WHEREAS, after careful study and being thoroughly familiar with the involved real estate and the surrounding area, said Commission has submitted its written recommendation to this Board to approve the preliminary plat; and
WHEREAS, this Board conducted a public hearing on September 15, 2026 in accordance with the above-noted Ordinance and Statute, and has examined the proposed preliminary plat; and
WHEREAS, after careful study, and due consideration this Board has determined that the proposed preliminary plat conforms to the requirements of Chapter 9.01-9.30. Subdivision Ordinance of the Pottawattamie County, Iowa, Code; the Pottawattamie County, Iowa, Land Use Plan and Chapter 354, Code of Iowa, and has deemed it to be in the best interest of Pottawattamie County, Iowa, to concur with the County’s Planning and Zoning Commission’s recommendation:
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF POTTAWATTAMIE COUNTY, IOWA: That the proposed preliminary plat of Pioneer Meadows Subdivision Phase 1, be, and the same is hereby approved as the preliminary plat of said subdivision.
Provided however, that this Resolution shall not be construed as being a final acceptance or approval of said Plat with the meaning of Chapter 9.01-9.30, Subdivision Ordinance, of the Pottawattamie County, Iowa, Code and Chapter 354, Code of Iowa; that after completion of all improvements and satisfaction of all requirements for final plats required by the State and County Ordinances and this Resolution, the final plat shall be submitted to this Board for its consideration.

ORDINANCE NO. 2026-05
AN ORDINANCE to amend the Official Zoning Map of Pottawattamie County, Iowa, by changing the district designation of approximately 3.77 acres from a Class C-2 (General Commercial) District to a Class A-4 (Loess Hills) District.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF POTTAWATTAMIE COUNTY, IOWA
SECTION 1 - AMENDMENTS: That the Official Zoning Map, as adopted by reference in Section 8.003.020 of the Pottawattamie County, Iowa, Zoning Ordinance, be and the same is hereby amended by changing the district designation from its present designation of a Class C-2 (General Commercial) District to a Class A-4 (Loess Hills) District, of certain real estate, as shown on the attached plat and which is legally described as follows:

SECTION 2 - SEVERABILITY: That should any section or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, that decision shall not effect that validity of the Ordinance as a whole or any part thereof, other than the part so declared to be invalid.
SECTION 3 - REPEAL OF CONFLICTING ORDINANCES: That all ordinance or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.
SECTION 4 - EFFECTIVE DATE: This Ordinance shall be in full force and effect after its passage, approval and publication as provided by law.

Motion by Wichman, second by Jorgensen, to approve First Consideration of Ordinance No. 2026-06, an ordinance to amend the Official Zoning Map of Pottawattamie County, Iowa by changing the district designation of approximately 4.71. acres from a Class C-1(Highway Commercial) to a Class I-1 (Limited Industrial) District; and setting date for Second Consideration for September 22, 2026, at 10:00 A.M. Recommendation for the landscaping buffer not be included in our ordinance to not be included.

AN ORDINANCE to amend the Official Zoning Map of Pottawattamie County, Iowa, by changing the district designation of approximately 4.71 acres from a Class C-1 (Highway Industrial) District to a Class I-1 (Limited Industrial) District.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF POTTAWATTAMIE COUNTY, IOWA

Motion by Jones, second by Jorgensen, to approve and sign Proclamation designating September 15th as Voter Registration Day.
Proclamation – National Voter Registration Day
WHEREAS, the right to vote is a fundamental part of civic participation, and voter registration is an essential first step for eligible citizens to exercise that right; and
WHEREAS, National Voter Registration Day is an annual nonpartisan civic observance dedicated to raising awareness of voter registration opportunities and helping eligible Americans prepare to participate in upcoming elections; and
WHEREAS, since its establishment in 2012, National Voter Registration Day has helped more than six million Americans register to vote or update their voter registration through the efforts of thousands of organizations and volunteers across the country; and
WHEREAS, changes such as moving to a new address, changing a name, becoming a United States citizen or reaching voting age may require an individual to register or update their voter registration information; and
WHEREAS, accurate and accessible voter information helps ensure eligible citizens understand how to register, verify their registration status and prepare to participate in the electoral process; and
WHEREAS, the Pottawattamie County Auditor’s Office provides residents with official voter registration information and resources, including opportunities to register online through the Iowa Secretary of State or by completing a voter registration form, as well as information for verifying an existing registration; and
WHEREAS, encouraging eligible residents to register to vote, keep their registration information current and seek election information from trusted official sources strengthens civic participation throughout Pottawattamie County;
NOW, THEREFORE, BE IT RESOLVED, that the Pottawattamie County Board of Supervisors hereby proclaims September 15, 2026, as National Voter Registration Day in Pottawattamie County and encourages all eligible residents to register to vote and prepare to make their voices heard in the upcoming election.

Motion by Wichman, second by Jones, to approve a contract with Convenient Care as the provider for Employee Occupational Health and/Work Comp provider,
